1. Company & Contractual Framework
- Service Provider: The B2B TRVL AIR online platform (the "Platform") is owned, developed and provided by TWENTYONE WEST COAST TRVL STORIES I.K.E., a company established in Greece with General Commercial Registry (GEMI) number 191601903000 ("TRVL" or "we"). Contact email: welcome@trvl.gr.
- Subject & Acceptance: These Terms of Use govern the contractual relationship between TRVL and each lawfully operating travel agency that registers for and uses the Platform (the "Agency" or "you"). Creating an account, accessing the Platform or using it in any way constitutes full and unconditional acceptance of these terms.
2. Description & Nature of the Service
- Functions Provided: The Platform is a specialised digital tool that gives the Agency:
- Access to a Global Network: The ability to book accommodation worldwide (hotels, villas, apartments) at net rates with live availability.
- Central Management System (Backoffice): A single environment for managing bookings, clients and collections, with independent setting of the profit margin (markup).
- Electronic Invoicing (Plus & Ultra Plans): Automated issuing of tax documents and transmission to the myDATA platform of the Greek Independent Authority for Public Revenue (AADE).
- Custom Website & Booking Engine (Ultra Plan): Creation of a personalised website with the Agency's brand and domain for direct B2C online bookings.
- Exclusively B2B Use: The Platform is exclusively a professional (Business-to-Business) tool. It is not intended for consumers or private individuals, and its use for purposes outside the Agency's commercial or business activity is prohibited.
3. Registration & Account Security
- Eligibility: Registration is open exclusively to lawfully operating travel agencies that hold an active, valid Greek VAT number (AFM) and a valid EOT Special Operating Licence (MHTE number).
- Review & Approval: TRVL reserves the right to verify the authenticity of the information submitted, to request additional supporting documents and to reject registration requests at its absolute discretion.
- Duty to Keep Information Updated: The Agency warrants the accuracy of its information and must notify TRVL in writing of any change in its corporate status (for example: change of VAT number or company name, revocation of the EOT licence).
- Security of Credentials: The Agency is solely responsible for keeping its access credentials confidential. Any act or transaction carried out through the account of the Agency or of its authorised sub-users (associates) is presumed to have been carried out by the Agency itself, which bears all related obligations in full.
4. Booking Terms & Process
- Source of Data: Accommodation prices, availability and cancellation terms are retrieved in real time from third-party suppliers and apply strictly at the moment of booking. The final net price and the applicable cancellation policy are shown explicitly for review before the transaction is finalised.
- Price Changes: If the price or availability changes between search and finalisation, the system automatically informs the Agency and no charge is made without its renewed approval.
- Commercial Relationship & Markup: The Agency contracts with its end clients in its own name and on its own account, independently setting the final selling price and the markup. TRVL is not a party to the relationship between the Agency and the end traveller.
- Legal Responsibility Towards Travellers: The Agency bears in full the responsibility of an organiser or seller of package travel or individual services, in accordance with applicable national and European tourism legislation.
- Cancellations & Amendments: Every cancellation or amendment is strictly governed by the policy of the accommodation concerned. Any cancellation fees or charges imposed by the supplier are borne exclusively by the Agency.
- Voucher Issuance: The booking confirmation and the corresponding accommodation document (voucher) are issued automatically and digitally by the Platform immediately after the process is completed.
5. Subscription Plans, Charges & Renewal Policy
- Plan Structure:
- Standard: Provided free of charge. Includes the basic management environment, the search engine and the ability to make B2B bookings.
- Plus: Costs €360 per twelve-month period. Also includes electronic invoicing and the myDATA connection, with an upper limit of 200,000 documents per contract year.
- Ultra: Costs €1,360 per twelve-month period. Includes all Plus plan benefits, as well as a customised white-label website with its own domain name and a B2C booking engine.
- Term & Automatic Renewal: The subscription has an annual term (12 months) and renews automatically for an equal period, unless the Agency cancels the subscription before the end date of the current billing cycle.
- Document Limit Policy (Plus & Ultra): There is no additional charge per individual document. If the Agency uses up the limit of 200,000 documents before the 12 months are complete, the subscription renews automatically for a new 12-month period (with the corresponding charge and a renewed limit of 200,000 documents), starting from the day the limit was reached.
- Cancellation & Downgrade: Cancelling or downgrading a plan takes effect after the end of the 12-month period already paid for, during which the services continue to be provided normally. After that date, the account automatically becomes a Standard account.
- No Refunds: Subscription fees paid are final, are not refundable and are not offset against unused time or unissued documents.
- Upgrade: An upgrade to a higher plan is activated immediately after confirmation of the related payment.
- Disputed Charges: Any errors or objections concerning charges must be submitted in writing to welcome@trvl.gr within a strict period of ninety (90) calendar days from the date of the charge.
- Price List Changes: TRVL reserves the right to change subscription fees and must inform the Agency by email at least fifteen (15) days before they apply. The new prices apply from the Agency's next scheduled renewal.
- Overdue Amounts: If a payment fails or a subscription is not paid, TRVL may immediately suspend access to the advanced functions of the plan (Plus/Ultra) until the debt is settled in full. During the suspension, the Agency's existing bookings and stored data remain safe.
6. Electronic Invoicing & myDATA Connection
- Certified Provider (YPAHES): The electronic document issuing service is provided through an approved technical connection with an official Electronic Document Issuing Service Provider certified by AADE (provider approval number: 029), which fully complies with the international information security standard ISO/IEC 27001:2022.
- Legal Status of the Issuer: The issuer of the documents remains exclusively the Agency, under its own VAT number. The Provider acts as a technical intermediary for authentication, for marking with a MARK number and QR code, and for automatic transmission of the data to AADE. TRVL undertakes the process of submitting the provider declaration to AADE.
- Supported Document Types: The Platform supports the issuing of Service Invoices (myDATA 2.1), Service Receipts (myDATA 11.2), Credit Notes (myDATA 5.1, 5.2, 11.4) and electronic invoices to public sector bodies (B2G).
- Disclaimer of Tax Liability: The Agency bears sole and full responsibility for the correctness, validity and lawfulness of the data it invoices (for example: counterparty details, correct VAT rate, selection of myDATA category and characteristics). The digital functions provided do not constitute or replace legal, tax or accounting advice, for which the Agency must consult its licensed accountant.
- Service Level (SLA) & Exclusions: The Provider targets 99.9% annual availability of the issuing and transmission service. The following are expressly excluded from the SLA calculation: scheduled maintenance; malfunctions, delays or outages of the central AADE/myDATA systems; connectivity problems with the Agency's internet network; and force majeure events.
- Offline Procedure: If communication with the systems of the Provider or AADE is technically impossible, the Agency is notified through the Platform or by email. In that case, the AADE procedures for issuing documents with later transmission are activated. Those documents are flagged by the system and sent to myDATA automatically as soon as the connection is restored.
- Technical Support: Invoicing support requests are submitted to welcome@trvl.gr. The Provider's technical support operates 24/7/365 by email, aiming to give an initial response within three (3) hours. Where necessary, a telephone call follows within the next working day.
- Filing & Retention: Issued documents remain accessible and available for export within the Agency's account throughout the subscription and after it ends (even if the Agency returns to the Standard plan). The statutory obligation for long-term retention of the tax archive rests exclusively with the Agency as issuer.
7. Custom Website & Booking Engine (Ultra Plan)
- Development & Domain Ownership: TRVL undertakes the creation and configuration of the website using the Agency's brand, logo and trademarks. The domain name must be registered in the name and ownership of the Agency.
- Intellectual Property of Material: The Agency must provide TRVL with the necessary creative material (texts, logos, photographs) and warrants that it holds the legal rights to use and reproduce it, releasing TRVL from any related third-party claim.
- Website Legal Compliance: It is the Agency's sole responsibility to publish on the website the company details required by law (company name, VAT number, MHTE number) and to prepare its own Terms of Trade and Privacy Policy (GDPR) for its end users and clients.
- Payment Gateway: Online collections by credit or debit card, Apple Pay and Google Pay are made through a direct connection with a licensed, certified Payment Institution. The Platform does not store or process raw card data (PCI-DSS compliance).
- Automated Synchronisation: All bookings made by end clients through the customised website are entered automatically and in real time into the Agency's central Backoffice.
8. Platform Availability & Maintenance
- System Operation: TRVL makes every reasonable effort to ensure the continuous and uninterrupted operation of the Platform. However, given the nature of the internet, it cannot guarantee 100% availability without technical interruptions.
- Scheduled Maintenance: Technical upgrade and maintenance work is carried out, as far as possible, during hours of reduced commercial traffic. Where a temporary interruption is expected, TRVL will notify Agencies in advance.
- Disclaimer for Third-Party Networks: TRVL bears no liability for malfunctions or interruptions caused by the systems of external providers (GDS, accommodation suppliers, AADE, telecommunications or internet providers) or by force majeure.
9. Limitation of Liability
- Accuracy of Accommodation Information: The visual and text material of accommodation (descriptions, photographs, amenities, maps) is provided directly by suppliers. TRVL takes every care in reviewing it, but bears no liability for any inaccuracies, typographical errors or misleading information from suppliers.
- Liability for Use: TRVL is not liable for any direct loss or loss of profit suffered by the Agency arising from: incorrect entry of data by users, loss of credentials, improper use of the account, or the Agency's business decisions on pricing and markup.
- Maximum Compensation Limit: In any event, to the maximum extent permitted by applicable law, TRVL's total aggregate civil liability towards the Agency for any claim for compensation is expressly limited to the amount of subscription fees actually paid by the Agency to TRVL during the twelve (12) months before the event causing the damage.
10. Personal Data Protection (GDPR)
- Processing Roles: With regard to the personal data of end travellers and clients entered into the system, the Agency acts as Data Controller and TRVL as Data Processor, acting strictly on the Agency's instructions and in accordance with the General Data Protection Regulation (GDPR, EU 2016/679).
- Data Transfers: The Agency acknowledges and accepts that, to perform the booking contract, the necessary traveller details must be transferred to the accommodation concerned and to the corresponding wholesaler or supplier of the service.
11. Term, Suspension & Termination
- Termination by the Agency: The Agency may close its account at any time by emailing welcome@trvl.gr. Prepaid subscriptions are not refunded.
- Suspension or Termination by TRVL: TRVL may suspend or close an account if the Agency ceases to hold an active EOT Special Operating Licence, breaches these Terms, or if there are reasonable indications of unlawful or abusive use.
- Confirmed Bookings: Bookings already confirmed continue to be served normally after termination.
12. Changes to these Terms
- Notice: TRVL may amend these Terms. Material changes are announced to the Agency by email at least fifteen (15) days before they take effect. If the Agency does not agree, it may cancel its subscription before they take effect.
13. Governing Law & Jurisdiction
- Law: These Terms are governed by Greek law.
- Jurisdiction: The courts of TRVL's registered seat have jurisdiction over any dispute.
